GENERAL CONDITIONS

House of Tilia is a Belgian online webshop offering a collection of goods for sale. The stated conditions below apply to all products bought by a House of Tilia shopper. When purchasing a good, the buyer agrees to the conditions. House of Tilia maintains the right to change its general conditions at any time.

This website is operated by House of Tilia. Throughout the site, the terms “we”, “us” and “our” refer to House of Tilia. House of Tilia offers this website, including all information, tools and services available from this site to you, the user, conditioned upon your acceptance of all terms, conditions, policies and notices stated here.

By visiting our site and/ or purchasing something from us, you engage in our “Service” and agree to be bound by the following terms and conditions (“Terms of Service”, “Terms”), including those additional terms and conditions and policies referenced herein and/or available by hyperlink. These Terms of Service apply  to all users of the site, including without limitation users who are browsers, vendors, customers, merchants, and/ or contributors of content.

Please read these Terms of Conditions carefully before accessing or using our website. By accessing or using any part of the site, you agree to be bound by these Terms of Service. If you do not agree to all the terms and conditions of this agreement, then you may not access the website or use any services. If these Terms of Service are considered an offer, acceptance is expressly limited to these Terms of Service.

Our store is hosted on Shopify Inc. They provide us with the online e-commerce platform that allows us to sell our products and services to you.

 

PRODUCT COLLECTION

House of Tilia puts a lot of time and effort into searching for qualitative and beautiful products around the world. We aim to inform you as correctly as possible about the nature and appearance of each good for sale. The product description gives background information and further specifications, the product photographs give a visual representation needed by the buyer to make a well-informed purchase. Most of our products are unique items, made by hand and no two will ever be identical. 

If a product is not in stock, it can not be bought nor shipped. You can ask to receive an email when the product is available for purchase again. House of Tilia maintains the right to adapt its collection.  

 

OFFER AND ORDER

An order can only be placed through www.houseoftilia.be

Orders placed through the website are deemed to be placed for non-professional purposes. These general terms and conditions of sale apply only to consumers within the meaning of Book VI of the Belgian Code of Economic Law, as inserted by the Act of 21 December 2013 inserting book VI "Market practices and consumer protection" in the Code of Economic Law and inserting the definitions own to book VI, and of the law enforcement provisions specific to book VI, in books I and XV of the Code of Economic Law, (BOG 30 December 2013, err., BOG 20 January 2014, err., BOG 18 March 2014, err ., BOG March 24, 2014). Merchants wishing to place an order for professional purposes should contact House of Tilia by email.

We undertakes to process the orders as long as stocks last and within the restrictions formulated in these conditions.

The online order can only be processed if the customer has clearly identified himself. The customer is responsible for providing its correct and exact coordinates (name, address, e-mail address, phone number) when placing an order. In case of error in the coordinates we cannot be held responsible for failure of delivery. In this case the costs of a new delivery will be borne by the customer.

We reserve the right to refuse orders in case of serious suspicion of abuse of rights or bad faith, serious suspicion of commercially unacceptable commercial purposes or depletion of the stock of a particular item.

Placing an order implies a payment obligation. The final confirmation of the order by the customer counts as acceptance of the order at the set price. The customer's validation counts as signature and express acceptance of all transactions via the website.


PRICING

Pricing

All product prices are stated in EURO, include VAT but exclude shipping costs. Shipping costs are separately calculated when checking out before the order is placed definitively, and depend on the weight/size of the products and the destination. House of Tilia maintains the right to adjust shipping costs when needed. More info on shipment can be read here. 

Sales outside of Europe

House of Tilia delivers to all European countries. If you are a non-EU customer and have your heart set on one of our goods, please contact us via the contact form on our website. Depending on your location, different tax rates and customs fees may apply. Please note that further information on such tax rates/custom fees cannot be given by House of Tilia.

Professional buyer 

If you are a professional buyer (non-Belgian), please contact us via the contact form on our website, clearly stating your VAT number. We will share the selling prices of our products excluding VAT that apply for you. The customer is responsible for the accuracy of the passed VAT number.


PAYMENT METHODS

Payment must go before delivery. Upon the system accepting the payment, we confirm the order via e-mail.

House of Tilia uses the secure payment systems PayPal and Mollie. These platforms use the Secure Socket Layer (SSL) technology that encrypts your information before it is sent to us. That way, House of Tilia or any other third party does not have access to any of your bank details.

SHIPMENT

Timing 

House of Tilia ships your goods within 3 working days (Monday-Friday). When your order is

placed during the weekend or on a holiday, the 3 days start counting on the next working day. In case you payed by bank transfer, the money needs to be received by House of Tilia before shipment can take place. If for any reason there might be a delay in shipment, you will be notified by mail or this will be clearly stated on the website landing page. We cannot accept responsibility for late deliveries due to circumstances outside of our control (ex. due to the carrier).

We strive for the shortest possible delivery period. The delivery period is a minimum of 1 working day and a maximum of 30 days after receipt of the payment for delivery in Belgium and a minimum of 2 working days and a maximum of 30 days in other countries.

Costs 

Shipping costs are separately calculated when checking out, and depend on the weight and/or measurements of the products. House of Tilia maintains the right to adjust shipping costs when needed.

Non-Collection of goods 

House of Tilia is not responsible for goods that were not collected by the buyer after attempt of delivery at the given address. Goods that were not collected will be returned to House of Tilia, and those shipment costs will be charged to the buyer. In case of an erroneous address, the responsibility and possible costs are also for the buyer. 

Damaged goods

It is very important that the buyer inspects the goods and their packaging upon reception. It is possible that the goods were damaged during transport, and this must be communicated to the transporter. The buyer immediately needs to inform us of the damage, with photographic proof. When it is clear the goods were damaged during transport, House of Tilia will refund or replace (in case of sufficient stock) the damaged ware free of cost.


RETURNS

14 days to return - right of renunciation

House of Tilia gives very explicit product descriptions and photographs to ensure you make a well informed buy. However, if the product(s) is/are not in line with your expectation, you have the right to return it/them within 14 calendar days after reception of the goods (starts counting the day after reception) without penalty and without giving reasons in accordance with articles VI 47-52 of the Belgian Code of Economic Law. Broken, used or damaged goods will not be refunded. If you have not contacted us within those 14 days, return and refund are no longer possible.    

How to return?

STEP 1/ Inform us about your wish to return a product/products and be refunded. Send us an email at info@houseoftilia.be, clearly stating your name, account number, and the product(s) you wish to return. To correctly and quickly use your right of renunciation, you can, if desired, complete the withdrawal form. The model withdrawal form can be downloaded here.

STEP 2/ Pack the goods carefully, unused and with original packaging if this is how you received them. Label and send the package to the following address through your local post office  transportation charges prepaid:

STEP 3/ Once we have received and checked the returned goods, House of Tilia will refund the product on the account number given by you within the 14 days. 

Exceptions 

Goods that have been damaged, broken or clearly used can not be returned nor refunded.


WARRANTY

Any problem or defect relating to the delivery of an article, damage or qualitative shortcoming must be notified in writing within seven days by email to info@houseoftilia.be or by registered letter to the address: House of Tilia, Wijnbergstraat 7, 3052 Oud-Heverlee, Belgium.

A solution is then sought together. If the delivery has to be returned to the shop, this will be done in the manner as mentioned under “Returns”. The costs of shipping from Belgium are at our expense. For shipping from other countries, the customer is responsible for the costs.

House of Tilia offers the guarantees provided by law.

We are not liable for force majeure, accident, misuse or incorrect handling of an item by the customer.

An article with an accepted defect will be replaced or repaired free of charge. If the costs of repair are disproportionate, we reserve the right to replace the item or refund it.

INTELLECTUAL PROPERTY

All photographs, logo’s, texts, product descriptions, etc. used on our website and social media accounts are intellectual property of House of Tilia. They may not be copied by other parties without written consent. 


APPLICABLE JURISDICTION

In case one of the mentioned conditions would be invalid, illegal or deemed null and void, this would not affect the legitimacy, validity and enforceability of the other conditions. What is not expressly provided in these terms and conditions of sale is governed by the provisions of Belgian law.

The Belgian law and jurisdiction applies. 

In case of contest, the courts of Leuven (Belgium) will be competent.
